1. Introduction
These terms govern the use of the Alhoshan Real Estate Platform and the services available through it. By using the website, submitting a request, adding a property, or communicating with the Alhoshan team, the user acknowledges acceptance of these terms, the privacy policy, the fees and commissions schedule, and the daily rental cancellation policy when using the booking service.
2. Scope of Services
Platform services include: real estate brokerage, real estate marketing, property listings, property requests, property management, real estate auctions, real estate financing, electronic lease contracts, daily rentals and bookings, communication and inquiries, and any other services announced by the company later.
3. Owner Obligations
The owner must provide accurate property data, not list a property they do not have the right to dispose of, provide ownership or authorization documents when requested, provide a real estate advertising license when required, provide a FAL license or proof of legal status when required, not mislead clients regarding price, description, area, or location, pay Alhoshan commission or agreed fees, comply with the property management contract if signed, comply with daily rental terms if the property is listed for booking, and bear responsibility for the accuracy of photos, documents, and data.
4. Broker Obligations
The broker must be licensed or legally qualified when required by law, provide FAL license data when requested, not list a property without valid authorization, clarify their status as a broker, comply with the agreed Alhoshan share, not exceed granted permissions, not provide misleading data, not use client data outside the scope of service, and comply with Alhoshan quality and review policies.
5. Client Obligations
The client must provide accurate contact data, use the platform for serious and lawful purposes, not submit fake requests, verify property details before making a decision, provide accurate data when requesting financing or a lease contract, comply with any announced fees before service execution, and respect communication etiquette.
6. Alhoshan Rights
Alhoshan may review any listing before publication, reject or delete any non-compliant listing, request additional documents, suspend user accounts, reject incomplete requests, modify how properties are displayed to serve platform quality, stop any service upon suspected misuse, retain request and conversation records to protect rights, and update fees and policies upon publication or user notification when needed.
7. Real Estate Brokerage and Commissions
Alhoshan commission when contracting directly with the owner is 2.5% of the sale value, or 2.5% of the first year rental value, unless a different written agreement exists. If dealing through a cooperating broker, Alhoshan share is 1.25% or as per a written agreement between Alhoshan and the broker. No commission is due except under a contract, agreement, completed service, or fulfillment of the entitlement reason specified in the agreement.

9. Property Listings and Advertisements
When adding a property, the user confirms that the data is accurate, photos are genuine and authorized for use, they have the right to list the property, the price is subject to update, publication does not mean final Alhoshan approval, and the listing may require a real estate advertising license or verification of FAL license or authorization. Publishing any misleading, unlicensed, or non-compliant listing is prohibited.
10. Property Management
Alhoshan provides property management services under a separate contract with the owner, which may include marketing, tenant management, contract follow-up, collection, maintenance, reports, coordination with service providers, field follow-up, request and complaint management, and renewal or eviction follow-up. Property management fees range from 7% to 30% depending on property type, portfolio size, and service scope.
11. Real Estate Auctions
Alhoshan may provide real estate auction services. Each bid is subject to specific terms including property description, starting price, participation mechanism, deposit or earnest money, participation fees if any, success commission of 5% or per auction terms, auction duration, award method, payment, and transfer or documentation procedures.
12. Real Estate Financing
Alhoshan allows submission of financing requests or coordination with financing entities. Alhoshan does not guarantee financing approval, financing amount, approval duration, profit margin, financing entity terms, or completion of the procedure.
13. Lease Contracts
Alhoshan service fee for a residential lease contract is 175 SAR. Alhoshan service fee for a commercial lease contract is 250 SAR. These fees are for Alhoshan service only and do not include any official fees, platform fees, value added tax, or electronic payment fees that may be due. Submitting a lease contract request does not constitute contract documentation itself.
14. Daily Rental and Booking
Alhoshan commission from the owner in the booking system is 18% of the booking value, and payment gateway or operational fees may be deducted per service provider. The owner must ensure property data accuracy, readiness, compliance with cancellation policy, cleanliness, and safety.
15. Cancellation and Refund Policy
Daily rental bookings are subject to the cancellation and refund policy published at /daily-rental-cancellation-policy, and a summary of the policy must be displayed before booking confirmation or payment.
16. Payment and Invoices
The platform may enable electronic payment, bank transfer, or other payment methods. Fees are displayed before execution when due, and value added tax and payment gateway fees may be added. Late payment may result in service suspension.
17. Intellectual Property
All platform rights, logo, identity, design, texts, images, databases, and software are owned by or licensed to Alhoshan Real Estate, and may not be copied or used without written consent.
18. Limitation of Liability
Alhoshan is not liable for inaccurate data provided by users, property price changes, unavailability of a property after listing, financing rejection, contract documentation rejection due to missing data or documents, violations by owner, broker, or client, external service failures, or user decisions based on unverified information.
19. Account or Service Suspension
Alhoshan may suspend, restrict, or delete an account upon violation of terms, submission of misleading data, platform misuse, publication of non-compliant listings, use of others' data without permission, violation of regulations, or request by a competent authority.
20. Governing Law and Jurisdiction
These terms are governed by the laws and regulations of the Kingdom of Saudi Arabia, and judicial or competent authorities within the Kingdom have jurisdiction over any dispute.
